This lawsuit revolves around unsolicited calls made by the Warranty Group Inc. and American Protection Plans LLC with the use of an automated dialer.  Class members contend that the defendants (aka Thee Warranty Group & American Protection Plans) made unsolicited calls with an automatic dialer to consumers’ cell phones and telephone numbers on the National Do Not Call Registry which is strictly against US Law.  Class members in the Flanigan v. The Warranty Group case are defined as anyone who received such as call from March 7, 2011 to Aug. 11, 2015.

Please note…

  • These automated calls were used as a marketing pitch to promote home warranty products sold by the firms
  • Call Back Settlement class members contend that these calls are in direct violation of the Telephone Consumer Protection Act
  • All exclusions and objections are due by Oct. 16, 2015
  • Settlement payments will range from $125 to $500
  • Two type of claim forms are available (long claim form and short claim form)

  • Learn more about the FTD Floral Arrangement Substitution Class Action Settlement entitled Rachelle Erratchu v. FTD.COM Inc

The case is in the jurisdiction of the California Superior Court for the County of Los Angeles and includes anyone who purchased flowers from FTD from April 1, 2011 until March 31, 2015.  The lead plaintiff in the case is Rachelle Erratchu and was filed in the summer of 2015.  Rachelle Erratchu claims that flowers of lesser quality were substituted for two arrangements that she purchased.  Class members contend that the firm did not properly disclose its substitution policy.

Please note…

  • All claim forms must in by Nov. 3, 2015
  • Class members are only allowed to come from the state of California and have a California billing address
  • Class members will receive a settlement in the form of a coupon worth $8.50 to $20
  • The fairness hearing will be held on 12/2/15
